In the interest of maintaining and hopefully increasing your property value, the Home Owners Association works to keep the neighborhood looking good and attractive to ourselves and future buyers. One aspect of fulfilling this goal is to provide guidelines or restrictions for all members to agree to follow so that we all participate in meeting the goal. The HOA Covenants contain the official restrictions of the Lakes. As with all rules that are expected to be followed, there has to be consequences for not following them. The Architectural Control Committee (ACC) has the responsibility to the homeowners to review and approve, or disapprove of any improvement on any and all lots. They also have the responsibility to enforce the rules and restrictions of the documented covenants of the subdivision. According to the by-laws, this committee has the right and authority to place a lean against any Lot Owner’s property for failure to follow the Covenants (Section 3.05).
To assist the ACC in the enforcement of the covenants, the committee has a subcomittee known as the Covenant Enforcement Committee ( CEC ), that is composed of 5 block captains. Their job is to find non-compliance issues and report them to the ACC. The ACC then advises the HOA President of the noncompliance issues and the President issues a letter to the lot owner accordingly to remedy the situation, or mitigate it. A lot owner has 10 days to respond to the letter before further enforcement action is taken. Members of the CEC are either chosen by the Architectural Control Committee from a list of volunteers, or else the President may appoint homeowners to serve if no volunteers are available.
